Legislature and litigating post-Kesner
This seminar will focus on the legislative and legal topics currently facing asbestos defendants. Specifically, we will look at how the plaintiff's bar is utilizing Sacramento to propose changes on deposition time limits and jury instructions. Topics discussed will include efforts to combat these proposals as well as the defense bar’s own effort to modify existing codes and jury instructions. We will also examine how attorneys can utilize jury instructions and motions in limine to defend cases, especially in light of Kesner v. Superior Court (2017) 1 Cal.5th 1132.

Understanding BAP-1 in asbestos cases
This seminar will focus on the medicine as it relates to asbestos cases. Can BAP-1 be utilized in favor for the defense, or does it create an "eggshell plaintiff" scenario? We will explore the role of BAP-1, its link to mesothelioma, and its use in asbestos cases.

Using People v. Sanchez against plaintiffs
The 2016 case of People v. Sanchez (2016) 63 Cal.4th 665 ruled on the necessary steps for the admissibility of expert testimony when it relies upon hearsay presented in the form of case-specific facts. We will explore how to use Sanchez offensively against plaintiff experts as well as avoid having it used against your experts.

Defending other cancers
As the landscape of remaining solvent asbestos defendants has altered, so has the focus of litigation into “other cancers.” Today, we are seeing an increase in filings of colon, lymphoma, stomach and kidney cancers. However, does medicine support a causal link? This presentation will address how to defend these types of cases.

Frank K. Berfield


is Counsel for the San Francisco office of Dentons. His focus is on products liability, general liability and complex torts. Frank has defended numerous civil and felony jury trials to verdict, and has recently obtained two defense verdicts in toxic tort cases. Frank received his J.D. from Oklahoma City University School of Law and is admitted in both the state of California, Oklahoma, as well as several U.S. District Courts (Central and Northern District of California, Western District of Oklahoma).

Edward P. Tugade


is a partner in the San Francisco office of Demler, Armstrong & Roland, LLP. He is involved in a variety of cases including product liability, general liability, professional liability, toxic tort and asbestos litigation. He has worked on trials, appeals and management of complex litigation in both state and federal courts. Ed is a decorated combat veteran of the U.S. Marine Corps and supervised its JAG law center. He received an honorable discharge after 10 years of active duty. Ed received his J.D. from U.C. Hastings College of the Law and is an adjunct professor at Golden Gate University School of Law.

Michael Belote


is the President of California Advocates, Inc., an advocacy firm established in 1970. Mr. Belote has over 38 years of experience representing a variety of clients before the Legislature and state regulators. He has previously worked as a legislative advocate for the California Society of Certified Public Accountants and the California Association of Realtors. Mike has also served as Vice President and Legislative Counsel for the California Land Title Association. Mike is a graduate of McGeorge School of Law.

Don Willenburg


is a partner at Gordon & Rees Scully Mansukhani and is the leader of the firm’s Appellate Practice Group. He is presently the chair for the amicus brief committee of the Association of Defense Counsel of Northern California and Nevada. Don has extensive experience in appeals, writs, and dispositive trial court motions in various substantive areas of law. He has been a guest lecturer at University of Southern California and Pepperdine Law Schools and has served as a volunteer judge pro tem and special master. Don received his J.D. from Stanford University.
